Enforcement is spearheaded by Ofcom, the independent regulator, armed with significant powers including substantial fines (up to ยฃ18 million or 10% of global revenue) and the potential for criminal liability, including imprisonment, for senior managers in cases of serious non-compliance, particularly regarding child safety duties. The Act mandates transparency, requiring larger platforms to publish detailed reports on their safety measures. While facing challenges and criticisms regarding potential impacts on free expression, privacy, and the burdens on smaller businesses, the Online Safety Act represents a pivotal shift towards a more accountable and safer digital environment in the UK, positioning it among the leading jurisdictions globally in regulating online harms.
